report to the sheriff once annually for 10 years and there is no provision for community notification. A Sexually Oriented Offender is a person who has been convicted of, or pleaded guilty to committing a Sexually Oriented Offense, but who has not been designated as a Sexual Predator or Habitual Sex Offender.
Habitual Sex Offenders
report to the sheriff once annually for 20 years and the sheriff may provide community notification only at the direction of the court. A Habitual Sex Offender is defined as a person who has been convicted of, or
pleaded guilty to committing a Sexually Oriented Offense, and who previously has
been convicted of or pleaded guilty to one or more Sexually Oriented Offenses.
Sexual Predators
are subject to registration and notification requirements for the offender's lifetime, unless a judge terminates the sexual predator designation, and they must verify residence address with the county sheriff every 90 days. After a sexual predator registers with the county sheriff, the sheriff is required to notify certain community members within a prescribed geographic area. Among the persons, the sheriff must notify are: school superintendents, police chiefs, neighbors (within 1000 feet of residence) and day care operators. Sexual Predator is defined as a person who has been convicted of, or pleaded guilty to, committing a Sexually Oriented Offense and who is likely in the future to commit additional Sexually Oriented Offenses. Offenders can be classified as Sexual Predators in one of the following ways:
(A). The offender is convicted of a Sexually violent Offense with
a Sexually violent Predator specification, or
(B). The sentencing court, after holding a Sexual Predator hearing pursuant to
O.R.C. (Ohio Revised Code) 2950.09 determines that the offender is a Sexual
Predator.
